MANUFACTURER'S WARRANTY MANUFACTURER’S LIMITED WARRANTY (ENGLISH) Tallon branded products (the 'Products') are manufactured by or for Tallon Marine Limited (Tallon) a company incorporated under the laws of New Zealand. Tallon warrants the Products as follows: As further set forth below, Tallon Socket (formerly know as 'Receiver') Units are warranted against defects in material or workmanship under normal use during the life of the vessel on which the Products are first installed by the original retail purchaser. Your exclusive remedy under the Tallon Socket Unit warranty is that Tallon will, at its option and to the extent permitted by law and as set forth below, provide a replacement to the original retail purchaser at no charge. All other Products are warranted against defects in material or workmanship under normal use for one (1) year from the date of the original retail purchase, except that in the European Union, the warranty period is two (2) years from the date of the original retail purchase. Your exclusive remedy for all other Products under this limited warranty is that Tallon will, at its option and to the extent permitted by law, provide replacement or a credit to the original retail purchaser for a Product at no charge. If a credit is issued, you may apply it towards the purchase of another Product. When a replacement is given, the Product for which the replacement is provided must first be returned to Tallon and becomes Tallon’s property. Labour, insurance and freight costs for returns are not included. No Tallon reseller, agent, or employee is authorised to make any modification, extension, or addition to this warranty, whether written or verbal. Tallon reserves the right to discontinue Products or to make substitutions. In such event, you may receive a substitute Product, a credit towards the purchase of another Product or a cash refund, at Tallon’s sole discretion, if a replacement for the Product covered by this warranty is no longer available. The limited warranty does not apply to any non Tallon-branded products, even if packaged or sold with Tallon Products and Tallon, in so far as permitted by law, has no responsibility for any non- Tallon branded products. Tallon is not responsible for damage arising from failure to follow instructions relating to the Tallon Product’s installation, maintenance and use. This limited warranty does not cover: Damage caused by use with non-Tallon products; Damage caused by accident, abuse, misuse, flood, fire, earthquake or other external causes; Damage caused by operating the Product outside the permitted or intended uses described by Tallon; A Product or part that has been modified to alter functionality or capability without the permission of Tallon; In the case of a Tallon Socket Unit, the lifetime replacement warranty does not cover any electrical parts (including but not limited to terminals, wiring and fuses capability) or any faceplate parts (including but not limited to the faceplate, grommet, gasket and screws) without the written permission of Tallon; Consumable parts, unless damage has occurred due to a defect in materials or workmanship; A product or part on which any Tallon serial number has been removed or defaced; Cosmetic damage, including but not limited to scratches; Normal fair wear and tear; Damage caused by repairs not authorized by Tallon. To the extent permitted by law, this limited warranty and the remedies set out above are exclusive and in lieu of all other warranties, remedies and conditions, whether oral or written, statutory, express or implied. TO THE EXTENT PERMITTED BY LAW, TALLON SPECIFICALLY DISCLAIMS ANY AND ALL STATUTORY OR IMPLIED WARRANTIES OR CONDITIONS, INCLUDING, WITHOUT LIMITATION, WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND WARRANTIES AGAINST HIDDEN OR LATENT DEFECTS.
